Understanding Greenville’s Referendum Ballot Questions

Greenville— Four referendum questions will be on the ballot for Greenville residents on Election Day, November 4.

The Greenville Town Council adopted Ordinance 1663, which the Mercer County Election Board approved as referendum questions.

"These proposed changes are the result of careful consideration by the Greenville Town Council,” said Town Manager Jasson Urey. “We want residents to understand the ballot questions and encourage them to come out and vote.”

Question 1, related to Section 1.1 of the Home Charter Rule

How will question 1 appear on the ballot?

Shall Section 1.1 of the Town of Greenville’s Home Rule Charter be amended to delete references to the term “Town of Greenville” and further amend the Home Rule Charter to reflect that the name of the municipal entity of Greenville shall be the “Borough of Greenville,” with the Home Rule Charter amended throughout to reflect these amendments?

What does question 1 mean?

The ballot question asks the voters of the Town of Greenville whether the Home Rule Charter shall be amended to change the name of the municipal entity of Greenville from the “Town of Greenville” to the “Borough of Greenville.”

A vote of YES will change the name of the municipal entity of Greenville to “Borough of Greenville.”

A vote of NO means that the name of the municipal entity of Greenville shall remain “Town of Greenville.”

Question 2, related to Section 3.6(c)(4) of the Home Rule Charter.

How will question 2 appear on the ballot?

Shall Section 3.6.(c)(4) of the Town of Greenville’s Home Rule Charter, which reads as follows: “[i]f a vacancy occurs between the general election and the beginning of the council term of office, the vacancy will be filled by the candidate with the next highest vote who was not elected,” be deleted in its entirety?

What does question 2 mean?

The ballot question asks the voters of the Town of Greenville whether the Home Rule Charter shall be amended by deleting Section 3.6(c)(4).

A vote of YES means that if a vacancy on Council occurs between the general election and the beginning of the Council term of office, then the Council may fill the vacancy with any qualified individual.

A vote of NO means that if a vacancy occurs between the general election and the beginning of the council term of office, the vacancy will be filled by the candidate with the next highest vote total who was not elected

Question 3, related to Section 3.6(c)(6) of the Home Rule Charter.

How will question 3 appear on the ballot?

Shall Section 3.6.(c)(6) of the Town of Greenville’s Home Rule Charter, which reads as follows: “[e]xcept in the case of (4) above, if an incumbent loses reelection in the last general election, he/she will not be eligible for appointment to a vacant council position for four years,” be deleted in its entirety?

What does question 3 mean?

The ballot question asks the voters of the Town of Greenville whether the Home Rule Charter shall be amended by deleting Section 3.6(c)(6).

A vote of YES means that if an incumbent member of Council loses reelection, he/she will be eligible for appointment to a vacant council position immediately upon such vacancy occurring.

A vote of NO means that, with the exception of a scenario where an incumbent councilmember loses reelection, but has the highest vote total among the unsuccessful candidates, and where a vacancy occurs between the general election and the beginning of the council term of office and such provision requiring the candidate with the next highest vote to be appointed to fill the vacancy remains valid, if an incumbent loses reelection in the general election, he/she will not be eligible for appointment to a vacant council position for four years.

Question 4, related to Section 7.1(a) of the Home Rule Charter.

How will question 4 appear on the ballot?

Shall Section 7.1(a) of the Town of Greenville’s Home Rule Charter be amended to read as follows? “All contracts of the town involving sums in excess of the “Written/Telephonic Bid” amount applicable to “Boroughs and Incorporated Towns,” contained in the Pennsylvania Department of Labor’s annual “Consumer Price Index Adjustment of Base Amounts on Bids” for the current year, shall be in writing and shall be executed on behalf of the town by the Mayor or, in the individual’s absence, the Town Clerk. The Mayor shall also execute all contracts, regardless of amount, for the purchase, sale, leasing, or use of real estate. Unless otherwise provided by ordinance, the Manager shall execute contracts on behalf of the Town involving sums of less than the aforementioned “Written/Telephonic Bid” amount made pursuant to budget or other prior authorization. Authorization for contracts for the construction of public capital improvements shall be given by ordinance. Any officer required to execute a written contract may request the town solicitor to approve the same as to form.” 

What does question 4 mean?

The ballot question asks the voters of the Town of Greenville whether the Home Rule Charter shall be amended to modify Section 7.1(a) from its existing language setting the threshold for executing contracts at a specific amount to a yearly variable amount identified by the state.

A vote of YES means that the threshold for executing contracts, currently set at Ten Thousand Dollars ($10,000), with contracts in excess of that amount executed by the Mayor or, in their absence, the Town Clerk, and contracts under that amount executed by the Manager, will be changed from Ten Thousand Dollars ($10,000) to the “Written/Telephonic Bid Amount” applicable to Boroughs and Incorporated Towns contained in the Pennsylvania Department of Labor’s annual Consumer Price Index Adjustment of Base Amount on Bids for a particular year.

A vote of NO means that the threshold for executing contracts, currently set at Ten Thousand Dollars ($10,000), with contracts in excess of that amount executed by the Mayor or, in their absence, the Town Clerk, and contracts under that amount executed by the Manager, will remain set at Ten Thousand Dollars ($10,000) without yearly variation.
